Planned Unit Development
Park Villas Association
- Peppertree is a Planned Unit Development, commonly referred to as a
PUD. The homeowners own the lot and the structure upon the lot as
opposed to a Condominium where the homeowners own only the rights to the
airspace within their designated unit.
In a PUD, the
homeowner’s association typically maintains the common area landscape,
pool and cabana facilities and designated exterior components of the
structures such as gutters, painting and roofing. Homeowners are
responsible for the windows, doors, plumbing, structural components,
interior components, and the treatment of infestations of and damage
caused by wood destroying pests and organisms - termites, dry rot,
fungus, etc.
Please refer to Section 8.3 of the
Conditions, Covenants and Restrictions for additional information
regarding maintenance responsibilities.

Governing Documents
The governing documents of Park Villas Association
– Peppertree are the Articles of Incorporation, Conditions, Covenants
and Restrictions (CC&R’s), Bylaws and Rules and Regulations as
approved by the Board of Directors.

Board of Directors
The Board of Directors is comprised of five (5)
unpaid volunteers elected by the membership. They meet on a monthly
basis to conduct Association business regarding finances, maintenance,
legal issues, architectural control, and other day-to-day activities of
the Association.
Assessments
Monthly assessments are due and payable on the
first day of each month and considered delinquent if not received by the
15th day of each month. Statements are mailed or emailed to
you each month prior to the first day of the month. Payments should be
mailed in the envelope provided or made online.
If you are a new owner, and do not receive a timely
statement, please check with your escrow company to see that they have
provided the management a copy of the conveying document so they may
change their record of ownership.

Courtesy, Cooperation and Consideration
These are the key elements to living in a planned
unit development such as Peppertree. Residents must take care to keep
the volume of entertainment devices, vehicles, or any other sound
equipment or machinery at a reasonable level so as not to disturb
others. Residents should be especially considerate during the late night
and early morning hours.
Fences
Exterior fences (those that can be seen in the
common area) are the responsibility of the Association. Fences shared by
neighbors between lots are the responsibility of the homeowners.
Neighbors must work together to maintain and replace their fences as
needed.

Garage Sales
All city codes must be followed. The City of San
José allows for only 2 garage sales per year per residence.
Items for sale may be temporarily placed in the
driveway area in front of the unit. The items are not to block access by
other residents to their units.
Residents are responsible to see that shoppers do
not park illegally or disturb other residents in any way.
Signs may not be attached to the Common Area
property such as fences or trash enclosures.
Any leftover "Free" items may not be placed in the
Common Area. Consider donating those items to a local charity.
Insurance
The Association maintains a master insurance policy
for general and liability insurance to cover our buildings, property and
facilities. If you would like detailed information regarding our
insurance, contact the management and they will refer you to the current
agent. A summary of the master policy coverage is provided each year
along with the annual budget.
Keys
Each unit is issued one
electronic gate card key for the pool area and restrooms. This key, when activated by
the management, will also allow for clubhouse access. Replacement keys
may be obtained from the management. The cost is $50. Checks should be
made payable to the Association.
Pool
Key Application
Keys will be
issued to Owners only.
New owners are
responsible for obtaining the card key and restroom key from the seller.
The Board reserves the
right to restrict or revoke access to the pool, cabana and restrooms.
Neither the management
nor the Association maintains keys to the residences. If you lock
yourself out of your unit you must call a locksmith or find an
alternative means of access.
Maintenance Requests
To report a maintenance issue in the common area
such as a broken sprinkler head or a roof leak, contact the Customer
Service Department at Community Management Services. Emergencies will be
handled on a priority basis. Routine maintenance will be handled as
appropriate during our normal course of business.

Meetings
The monthly meeting of the Board of Directors is
typically held in the cabana.
Meeting dates are published in the newsletter each month. Occasionally
it is necessary to reschedule a meeting due to unforeseen circumstances.
Any changes in the meeting date or time will be noted in the newsletter
and/or posted at the kiosk in front of the cabana.

Annual Meeting
The annual meeting of the membership is held in
December of each year. Owners are encouraged to attend. In order for the
Association to obtain the required quorum of members to conduct the
business of the Association, Members are required to sign and return
voting materials.
Newsletters
A monthly newsletter is published and mailed or
emailed with
your monthly statement. The newsletter serves to inform you of upcoming
scheduled events, maintenance, changes to our policies and regulations,
and other information regarding our Association. Please be sure to read
it each month.

Rental Property
Leasing
Your Unit
Per CC&Rs Section 4.3a:
"Not more than twenty-five percent (25%) or forty-four (44) of the one
hundred seventy-six (176) of the Residences within the Development shall
,at any particular time, be leased or rented or occupied by anyone other
than an Owner, members of his or her household, or temporary guests."
Homeowners who elect to
lease their Unit must first obtain approval from the Association.
Upon approval, please
submit your new residence address and applicable numbers and the names
and phone contacts of all residents.
The CC&R's require
rental/lease agreements to be made subject to the CC&R’s. Be sure
to check your agreement form to verify that it includes this
stipulation.
Homeowners are
responsible for the actions of their tenants. It is required that you furnish your tenant
with a copy of the CC&R’s and a Rules and Regulations Booklet.
Insist that a statement be signed indicating that they have read,
understand and agree to abide by these documents.
Copies of the
CC&R’s are available through the Association at the Management
office for a reasonable fee. Homeowners will be held responsible to
attend any fine hearing and for any
fines or penalties that result from the actions of their tenants.

Water
The Association pays all water bills. Residents are
required to use water carefully and to conserve as much as possible.
Each cluster is monitored for excessive water usage.
