Animals and Pets
No
animals, livestock or poultry of any kind shall be raised, bred or kept
on any unit or in the Common Area, except that dogs, cats or other
household pets may be kept in units, subject to rules and regulations
adopted by the Association. All pets must be maintained on leash while
in the Common Areas of the Association. Residents are responsible to
clean-up after their pets. As used in this Declaration,
“unreasonable quantities” shall be deemed to limit the total number
of all dogs, cats, and birds to two (2) per Unit.
The Association shall have the right to prohibit
maintenance of any animal, which constitutes, in the sole and exclusive
opinion of the Board, a nuisance to any other Owner. Each person
bringing or keeping a pet upon the development shall be absolutely
liable to each and all other Owners, their family members, guests,
invitees, lessees, renters and contract purchasers, and their respective
family members, guests, invitees for any damage to persons or property
caused by any pet brought upon or kept upon the development by such
person or by members of his family, his guests or invitees.

Common Areas - Driveways, Walkways, Landscaping and Refuse Enclosures
Storage of items outside of the unit in the common
areas such as driveway areas, walkways, landscape or refuse enclosure
areas etc. is prohibited.
Nothing shall be
done or kept in the Common Area, which will increase the rate of
insurance on the common area without prior consent of the Board of
Directors of the Association.
No litter or waste
shall be disposed of in the common area.
Out of respect for
residents living in adjancent homes and/or enjoying common areas, no
smoking is allowed at any time in front of the cabana, the pool
enclosure or any walkways and garden areas.
Lighting
Exterior building, driveway and common area
lighting is maintained by the Association. Residents may not tamper with
or adjust lighting control units. Should the lighting require other than
regularly scheduled service, please notify the Board of Directors of the
Association. If a light is operated by a switch inside a Unit then the
unit owner is responsible to maintain the light.

Parking
Resident parking is
authorized in the unit’s assigned garages. Each unit has two
assigned/deeded parking space(s) in the attached garage. Unauthorized
use of and/or blocking of a garage entrance are subject to vehicle
removal without notice at the owner’s expense. Vehicles parked outside
these areas and/or in a fire lane are subject to removal without notice.
- No vehicle shall remain parked in a common area
parking space for more than 72 consecutive hours. Note: Vehicles
moved from one space to another for the purpose of complying with
the 72-hour parking rules are considered stored and are subject to
removal from the property.
- Parking spaces shall be used for the temporary parking
of automobiles only and shall not be converted for living or
recreational activities.
- No boats, trailers, recreational vehicles, campers,
non-commercial trucks larger than ¾ ton shall be parked or left in
common area parking spaces.
- Vehicles that lack current posted registration, are
undergoing repairs, are inoperable or stored are prohibited and are
subject to removal at the expense of the vehicle owner.
- Commercial Vehicles: Parking of any commercial
vehicles on all private street, (Bluegrass, Bottlebrush, Star Bush,
Hollyleaf, Sunflower, and Strawflower), regardless of the size, is
prohibited at all times unless said vehicle is engaged in work on
the property or at an individual unit. A vehicle qualifies as
commercial if any one of the following: evidence of tools of trade
and/or a display of business affiliation identification.
- Vehicles in violation of these policies may be towed without
notice at the owner's expense.

Property use and resident conduct
No noxious or offensive
activity shall be carried on in or upon any unit or in the Common Area,
nor shall anything be done which may be or become an annoyance or
nuisance to the other owners.
Residents must keep the
volume of voices, entertainment devices, vehicles, or any other sound equipment
or machinery at a reasonable level so as not to disturb others.
Residents should be especially considerate during the late night and
early morning hours.
Each lot and Common
Area shall not be used in such a manner so as to obstruct or interfere
with the enjoyment by residents of other units or annoy them by
unreasonable noises, nor shall any nuisance or immoral or illegal
activity be committed or permitted to occur.
Homeowners are
responsible for all actions/damages caused by their tenants and/or
guests.
Residents and
contractors must conform to respectful work hours.

Recreational Activities
No permanent sports items such as basketball nets may be
placed in the common area. Bicycle, skateboard, scooter, roller blade or
other such similar items are prohibited from being operated on the lawn,
sidewalks, or driveways within the complex. No
climbing or playing in the trees, shrubbery or planted areas is allowed.

Refuse
A maximum of two (2) containers with lids per unit
marked with unit address will be allowed in the refuse enclosure areas
located in each cluster. The enclosure areas must be kept clean and free
of debris. No items other than refuse containers may be kept in these
areas.
Refuse must be put inside the refuse containers.
All cardboard boxes must be broken down and flattened before discarding
or the refuse service will not pick up. In,
addition, kitty litter should be placed in securely fastened plastic
bags before disposing to prevent spillage. Yard waste may be placed in
the street on Lyonsville or Seifert one night prior to pick up.
Refuse removal service is contracted for and paid
for by the individual unit owners and/or residents. Replacement and
supply of containers are also the responsibility of the resident.
Residents should follow container and refuse guidelines as established
by the refuse service. Refuse and recycling containers must be returned
to the garbage enclosure or garage within 24 hours.
No one shall allow rubbish, trash, or garbage to
accumulate on his/hers lot to the extent that it is a health hazard or
that it is aesthetically objectionable. The Board of Directors of the
Association shall be entitled to impose reasonable penalties for
collection of garbage and refuse which is disposed of in any manner
inconsistent with these regulations.

Seasonal Decorations
Seasonal decorations may be temporarily attached to
your unit but must be removed within two weeks after the holiday. All
decorations must not interfere with the use or maintenance of the common
area and pose no hazards and damage. No decorations are allowed on the
roof.

Signs
One for-sale sign or
for-lease sign may be placed in the common area in front of the unit.
Signs must be no larger than 3’ x 3’. Care must be taken in the
installation of posts. Any damage to the common area such as to
irrigation lines, irrigation valves, or electrical wiring will be the
responsibility of the homeowner.

Speed Limits
All residents and guests must follow posted speed
limits.

Vehicle
Maintenance, Repair
and Sales
Vehicles that leak oil
may not be parked in the common area. In the event this should happen,
the excess oil must be cleaned-up immediately. Violations of this
guideline by a homeowner, tenant or guest are subject to clean up by the
Association without notice. Association clean up is subject to Special
Reimbursement Billing (SRB) to the property owner.
Vehicle repair in the
common area is prohibited. This includes oil changes, draining radiators
and/or any other major repair. Vehicle sales in the common area and on
private streets is also prohibited.
Inoperable vehicles are
subject to removal without notice at the owner’s expense.
No vehicle may be spray
painted in the common area, including garage areas, driveways and common
area parking spaces.
Violations of Association Rules and Policies
It is the intention and the express obligation of
the Board of Directors to enforce the Bylaws, CC&Rs and other
regulations of the Association to ensure the safety and enjoyment of the
neighborhood for all residents and guests. Violations may result in
fines, penalties or revocation of member privileges. Residents are urged
to consult the CC&Rs, Bylaws as well as the appendices to the Bylaws
for additional information.
